NY court rejects Shell’s challenge over Venture Global arbitration decision

The New York Supreme Court has rejected Shell's appeal in an arbitration case against US LNG exporter Venture Global LNG over LNG sales from the Calcasieu Pass plant in Louisiana

Venture Global announced this in a statement on Monday.

“We welcome the New York State Supreme Court’s complete denial of Shell’s petitions to overturn the unanimous arbitral award issued in favor of Venture Global in August 2025,” the company said.

“After years of motions, hearings, and testimony, the Court confirmed the decision of the tribunal that found Venture Global honored its negotiated contract. We are pleased to move forward and have decisive resolution on this matter,” Venture Global said.

LNG Prime invited Shell to comment on the decision.

“We recognize that courts are reluctant to challenge arbitral awards but we did believe in the strength of our case. We are disappointed in the outcome,” a Shell spokesperson said.

Venture Global announced in August last year that the partial final award was issued by the International Chamber of Commerce, International Court of Arbitration in the arbitration proceedings between Venture Global Calcasieu Pass and Shell NA LNG regarding LNG sales from the Calcasieu project under the LNG sales and purchase agreement entered into by the two firms.

In contrast, UK-based energy giant BP won an arbitration case against Venture Global over the same issue.

Shel said in November 2025 that it had filed an application in the New York Supreme Court to set aside the Tribunal’s liability award.

“The application alleges that Venture Global procured the award by improperly withholding material information from Shell and the Tribunal,” Shell said at the time.

Calcasieu Pass

Calcasieu Pass produced its first LNG on January 19, 2022, moving from FID to LNG production in 29 months, while the first commissioning cargo left the facility on March 1, 2022.

In April last year, Venture Global launched commercial operations at its Calcasieu Pass LNG terminal, some 68 months from its final investment decision and 38 months after production start.

Besides Shell and BP, other Calcasieu Pass offtakers are also in dispute with Venture Global over LNG sales from the Calcasieu Pass terminal.

Venture Global recently won an arbitration case against Spanish energy firm Repsol over LNG sales from the Calcasieu Pass plant.

Other customers of the Calcasieu pass facility include Galp, Edison, PGNiG, now part of Orlen, Sinopec’s unit Unipec, and CNOOC.
